collaboration with a fixed telephony operator with national coverage (hereinafter,
the "Telephone Network Operator").
The YA.COM Voice Service, under the type of indirect access through
pre-selection or direct dialling, is configured as a complementary service
to the YA.COM Access Services, under the types that permit it; therefore
it may only be contracted jointly with any of the YA.COM Access Services
and exclusively within the framework of the different packages or commercial
offers (hereinafter the "Commercial Offers") that YA.COM may
make available to the Customer at all times through the URL http://acesso.YA.COM
(hereinafter the "Access Page"). These Particular Conditions,

telephony service with national coverage that is offered under the flat
rate type, i.e. for a monthly fixed payment that shall cover all calls
indicated in the Commercial Offer to fixed geographic numbers, regardless
of who the telephone operator is who receives the call. In addition, the
CUSTOMER may, within the framework of the YA.COM Voice Service,

address stated in the contract process. These Customers may not act as
a reseller or distributor of any type of service to third parties, nor
use the YA.COM Voice Service outside of the residential or company
address on the contract.
The CUSTOMER shall be understood as all individuals or legal entities
that use or request the YA.COM Voice Service, who do not develop

entity that is contracting the service.
Two. Prior Requirements.
Compliance by the CUSTOMER and/or owner of the line for which the Service
is requested with the requirements listed herein, according to the statements
below, shall be considered as essential and necessary for the provision
of the YA.COM Voice Service. The non-existence thereof prevents the YA.COM
Voice Service contract from being executed, which is deemed as not having
been signed for any purpose, without prejudice to the provisions in the
General Contract Conditions of the YA.COM Access Services, of which this
service is configured as an Additional Service with regard to the ongoing
provision of Internet access service as a main service:
(i) Being a CUSTOMER at all times of any of the YA.COM Access Services

by YA.COM.
4.2. Temporary Service interruptions: In the event that temporary
interruptions take place in the YA.COM Voice Service that are attributable
to YA.COM, the latter shall return to the CUSTOMER, in accordance with

to the period in which the failure occurred, prorated for the time that
the interruption lasted.
In the case of an account that is less than three months old, the amount
of the average bill for the completed monthly periods shall be considered,
or the amount that would have been obtained in an estimated monthly period,
proportionately to the consumption period that actually took place.
A service interruption is understood to be that failure where the CUSTOMER
cannot make any call through the YA.COM Voice Service. In order to calculate
the duration of the Service interruption, the date and time when the YA.COM

be taken as the START, and the date and time when the Service is resumed
shall be taken as the END.
YA.COM shall be under obligation to indemnify the CUSTOMER automatically,
by the bill amount pertaining to the period immediately prior to the period
under consideration, when the service interruption involves the right
to indemnification for an amount greater than 1 euro.
In interruptions due to causes of force majeure, YA.COM shall be limited
to automatically compensating the CUSTOMER by returning the sum of the
monthly fixed quota and others independent of the traffic, prorated for
the time that the interruption had lasted.

of the following causes:
i) Serious non-compliance by the subscribers with the contractual conditions,
